Article I - Name & Founding
   
Section 1.

The Name of this organization shall be the PENNSYLVANIA INTERSCHOLASTIC MARCHING BAND ASSOCIATION, herein referred to as PIMBA.  [Original 1996]

   
Section 2.

The circuit championships shall be referred to as the Pennsylvania Interscholastic Marching Band Association Championships. [Winter 2002]

   
Section 3.

PIMBA was founded in February of 1996, thus effecting a split from the PA Federation of Contest Judges.  The PFCJ had administrated the competitive band activity advised by a Director's Advisory Board/Board of Governors.

  Thirteen members participated in the first PIMBA State Championships at North Allegheny HS on Saturday, October 26, 1996.
   
  The original manual was based on those of the Lakeshore Marching Band Association (LMBA) and Bands of America (BOA) as compiled and adapted by Charles Prijatelj from Mars HS and Tom Snyder from West Allegheny HS.

Article II - Goals
   
Section 1. The purpose of the PIMBA is to provide the philosophical and organizational structure for marching band field competitive events in southwestern Pennsylvania as hosted by its member directors.
   
Section 2. The goals of the PIMBA are: to promote participation in marching band field events, to promote the art form of competitive marching band based on the pedagogy and philosophies of quality music education, and to promote professionalism, cooperation, and respect among all bands, Directors and Staffs, students, parents, parent organizations, adjudicators, and all others affiliated with PIMBA.
   
Section 3. The PIMBA is a marching band circuit founded, structured, administrated, implemented, and monitored by Directors to educationally and artistically benefit member Bands.

Article III - Membership

   
Section 1. The Director shall be the member of the PIMBA and therefore is responsible for payment of the annual membership dues.  The Director shall be the representative of the band and school district and is responsible for upholding the Code of Ethics, Constitution, and Bylaws.
   
Section 2. The Membership period shall be from the first PIMBA-sanctioned competition of the season to the first PIMBA-sanctioned competition of the next season.
   
Section 3. Membership shall be continuous until the member resigns or fails to pay the annual dues.  In the event a Director leaves the marching band position during the school year, the successor shall assume the membership. As a courtesy, the director of a band that becomes inactive remains on the contact list for one year and is welcome to attend meetings during that year as a non-voting member.
   
Section 4. Interested directors shall contact the PIMBA President concerning new membership, who will direct them to register through the PIMBA website to initiate the membership process. [Winter 2004]
   
Section 5. A Band may participate in one PIMBA-sanctioned competition as a guest.  The director of a guest band that wishes to participate in a second PIMBA-sanctioned competition within any single season must become a member.
   
Section 6. Member Directors shall be provided annually with a PIMBA roster and .pdf file of the current manual.  The roster and manual shall be posted on the PIMBA web site at www.pimba.org. [Winter 2004]

Article IV - Dues & Fees

   
Section 1. The annual membership dues shall be established no later than the annual Winter Meeting.
   
Section 2. The annual membership dues shall be submitted no later than prior to the band's second PIMBA-sanctioned competition of the season. A band that has not submitted payment shall not be permitted to participate in that second competition. [Winter 2004]
   
Section 3. Directors of guest bands, defined as non-member bands who participate in only one PIMBA-santioned competition within a single season, are not required to submit dues.
   
Section 4. A band that withdraws within two weeks of a show shall be charged a withdrawal fee payable to the Host Director to best help cover the involved costs. [Winter 2004]
   
Section 5. A Host Director who cancels his show later than three weeks after the show-scheduling deadline shall be responsible to reimburse PIMBA for any non-recoverable judging and travel fees for outside judge(s) contracted for his show. [Winter 2004]
   
Section 6. A member band that has not submitted payment for outstanding dues or fees by the end of a given season shall not be permitted to participate in its first scheduled PIMBA-sanctioned competition of the following season until payment is submitted. [Winter 2004]

Article V - Voting Privileges
   
Section 1. A voting member is a Director who has submitted the membership application and dues payment AND whose band has participated in at least two PIMBA-sanctioned competitions during the most recent marching band season.
   
Section 2. A non-voting member is a Director who has submitted the membership application and dues payment whose band has NOT participated in at least two PIMBA-sanctioned competitions during the most recent marching band season.  Non-voting members are strongly encouraged to attend meetings and actively participate in agenda and discussions.
   
Section 3. Member directors shall submit the formal Judge Evaluation no later than by the annual Fall Meeting. A band that does not submit this document prior to the annual Winter Meeting shall not be permitted to vote at that meeting. [Winter 2004]

Article VI - Administrative Structure
   
Section 1. OFFICERS
   
Section A. The Officers shall be a President, Vice President, Secretary, and Treasurer from separate programs who are active, voting member directors or a past director who remains directly involved with that district's marching band. The band director would remain the voting representative. Should the director also be a class representative on the Executive Board, the director would remain the voting representative. Section B. Nominations for officers shall be accepted from the floor at the annual Winter Meeting.  A nominee must give permission to be nominated.  A simple majority of the voting members present shall be needed for election.  A runoff election will be held in event of a tie.
   
Section C. Terms of office shall be for two (2) years, with the President and Secretary being elected on even-numbered years and the Vice President and Treasurer on odd-numbered years.  Officers may be re-elected.  A member shall hold only one office at a time.
   
Section D. If a vacancy occurs in an office, the President shall appoint a voting member to fill the office on an interim basis until the next general meeting.
   
Section 2. DUTIES OF OFFICERS
   
Section A. The President shall perform the following duties:
   
  1.  Preside at all official meetings of the PIMBA and its Executive Board.
   
  2.  Appoint all committee chairpersons and be an ex-officio member of all committees.
   
  3.  Forward a copy of any PIMBA correspondence to the Secretary for placement in the permanent records.
   
Section B. The Vice President shall perform the following duties:
   
  1.  Assist the President when called upon.
   
  2.  Perform the duties of the President in his absence.
   
Section C. The Secretary shall perform the following duties:
   
  1.  Keep accurate minutes of all official meetings.  Provide a verbal report of minutes from the previous general meeting for each general meeting of the membership.
   
  2.  Maintain a permanent record of all PIMBA documents, which is property of the PIMBA, whose contents shall be available to any member upon request.  Upon leaving the office, the permanent records shall be transferred to the incoming secretary.
   
  3.  Assist the President in the preparation and mailing of any PIMBA correspondence, keeping a copy as part of the permanent records.
   
  4.  Provide effective communications and public relations with the membership, other Directors, the PMEA, and the media.
   
  5.  Maintain accurate membership roster data to provide the webmaster for posting as well as to the Championship Show Host Director and to the membership upon request.
   
Section D. The Treasurer shall perform the following duties:
   
  1.  Receive all funds and pay all bills or disbursements authorized by the Executive Board or the membership.
   
  2.  Keep an itemized account of all receipts and disbursements and present verbal and written reports at each general meeting.
   
  3.  Sign PIMBA checks accompanied by the signature of the President.
   
  4.  Submit an annual report to each Officer and Executive Board member no less than fourteen (14) days prior to the Winter Meeting.
   
  5.  The office of Treasurer shall be bonded and the financial records shall be externally audited annually.  Both fees are to be paid by the PIMBA.
   
  6.  The fiscal year of the PIMBA shall be from March 1 through February 28.
   
Section 3. EXECUTIVE BOARD
   
Section A. The Executive Board shall consist of ten (10) members:  the four Officers, the immediate Past President and five elected members, one representing each band classification - A, AA, AAA, AAAA, National.  [Winter 2003]
   
Section B. Nominations for the Executive Board shall be accepted from the floor at the annual Winter Meeting.  A nominee must give permission to be nominated.  A simple majority of the voting members present shall be needed for election.  A runoff election shall be held in the event of a tie.
   
Section C. The term of service on the Executive Board shall be for one (1) year.  Executive Board members may be re-elected.
   
Section D. If a vacancy occurs, the President shall appoint a voting member to fill the position on an interim basis until the next general meeting.
   
Section 4. DUTIES OF THE EXECUTIVE BOARD
   
Section A. The Executive Board shall conduct the affairs of the organization between general meetings of the membership at a location determined by the President.  A quorum shall consist of three members.
   
Section B. The Executive Board shall be responsible to interpret the Code of Ethics, Constitution, and Bylaws, as well as any other policies.
   
Section C. The Executive Board shall oversee the work of all committees.
   
Section D. The Executive Board may approve expenditures.
   
Section E. The Executive Board shall arbitrate any inquiry and make recommendations of action consistent with the Code of Ethics, Constitution, and Bylaws.
   
Section F. Additional duties of the Executive Board shall be designated by the President or the membership.
   
Section 5. STANDING COMMITTEES
   
Section A. Standing Committees shall be organized within these general guidelines:  each committee shall have a chairperson and at least two (2) additional members; the membership term shall be for one year or completion of the assigned duties; and, members may be  re-appointed.
   
Section B. Each Standing Committee shall meet at the call of the Chairperson, at the direction of the President, or at the direction of the membership.
   
Section C. Each Standing Committee shall choose a recording secretary who shall keep minutes of their meetings and submit a copy to the President within a week of a meeting.  Chairpersons shall report as necessary or as requested to the Executive Board and shall prepare a written report to the membership at the next general meeting.  A copy of each report shall be submitted to the secretary to be placed in the permanent records.
   
Section D. Special Committees may be appointed by the President, Executive Board, or the membership as needed.

Article VII - Meetings
   
Section 1. The annual PIMBA meeting shall be scheduled at the same time frame each year so that member directors can be more aware when setting their professional and personal calendars, to maximize attendance. [Summer, 1999, Executive Board]
   
Section 2. The location of the formal Fall and Winter Meetings shall be at a site designated by the President.
   
Section 3. The following shall occur at any general meeting of the membership:  a copy of the written minutes from the previous general meeting shall be provided for each attending member and presented by the Secretary for approval ; reports from the Treasurer as delineated in Article VI, Section 2D; reports from the Executive Board or any Standing Committees; pending old business items; and any new business items that may properly come before such a meeting.
   
Section 4. A quorum at a general meeting shall consist of the members present.
   
Section 5. The Executive Board shall meet at the call of the President or of any two of its members.  Notice of such meeting shall be given to all members at least fourteen days in advance.
   
Section 6. A Standing Committee shall meet at the call of its chairperson or of any two of its members.  Notice of such meeting shall be given to all members at least fourteen (14) days in advance.
   
Section 7. Special meetings of the membership may be called by the President, by any three (3) members of the Executive Board, or by one-third of the voting membership.  Such call shall be in writing, directed to the Secretary, signed by the calling parties and stating the purpose of the call.  Upon such call, the Secretary shall give written notice of this meeting, indicating the specific purpose, to all members.  Notice of such meeting shall be given to all members at least seven (7) days in advance.  Only the specific business stated in the call may be transacted at this meeting.

Article VIII - PIMBA-Sanctioned Competitions:  Structure
   
Section 1. SEASON SCHEDULE.  PIMBA shall utilize a Show Seeding process to determine the initial competition schedule for the upcoming season at the annual Winter Meeting.  [Fall, 1997]
   
Section 2. SHOW CONTRACTS.  Show contracts shall be distributed to hosts at the annual Winter Meeting when the initial competition schedule is determined.  [Winter, 2004]
   
Section 3. SHOW CANCELLATION.  A Host Director may withdraw from hosting his show within a specified time frame without penalty.  [Winter, 2004]
   
Section 4. BAND CLASSIFICATION. Five classes of bands shall be established for competitive performance, with two additional classes for non-competitive performance.
   
Section 5. NUMBER OF BANDS PERMITTED IN A SHOW.  There shall be no limit to the number of bands that may appear unless set by the Host Director due to facility restrictions.
   
Section 6. SHOW PARTICIPATION.  Each member director shall indicate his formal intent for his band to participate in individual PIMBA-sanctioned shows via the website.
   
Section 7. SHOW WITHDRAWAL.  A band may withdraw from a show no later than two (2) weeks before in advance without penalty. [Winter, 2004]
   
Section 8. PERFORMANCE SCHEDULE.  The Host Director shall determine the overall schedule for his show given the latest permitted ending time, including performance order of participating bands, optional guest bands, and intermission.
   
Section 9. CANCELLATION OR MOVE INDOORS.  The Host Director shall be responsible for the decision to change the format of the show due to field and/or weather conditions.
   
Article IX - PIMBA-Sanctioned Competitions:  The Event
   
Section 1. EVENT RESPONSIBILITY. 
   
Section A. The Host Director shall be responsible to the PIMBA in all matters pertaining to the event.  The Host Director may delegate responsibilities, but such delegation shall not abdicate responsibility for any violation of PIMBA policies, the Code of Ethics, Constitution, or Bylaws.
Section B. The 'final call' on an 'event policy/procedure' issue at a regular season or the Championship Show shall be the responsibility of the ranking PIMBA officer and available Executive Board members present as well as the Host Director.  The 'final call' on a 'facilities/site' issue shall be the responsibility of the Host Director.  [Winter 2003]
   
Section 2. HOST RESPONSIBILITIES.   The fundamental responsibilities of the Host Director include, but are not limited to:
Section A. To implement all PIMBA competition-related policies and procedures.
Section B. To provide a performance venue in the best possible condition, lined appropriately with yard markers provided at field ground level.
Section C. To provide adequate facilities for the parking and security of band buses, equipment vehicles, emergency vehicles, adjudicators, and the audience.
Section D. To provide adequate facilities for band warm-up and holding areas, rest room access, and post-performance seating for each band.
Section E. To provide adequate preparation, judging, and critique areas for the adjudicator, including keeping the press box/judging areas clear of distractions, chairs, a writing surface, and room for tapes, sheets, and supplies.
Section F. To provide a viewing area for the participating Directors and Staff.
Section G. To provide a videotaping area for each band if possible.
Section H. To provide, if at all possible, a complimentary high camera DVD or VHS for participating bands of their band's performance for educational purposes only, and to inform participating bands as part of the pre-show information packet whether or not the band's performance will be able to be videotaped.  [Winter 2003]
Section I. To develop a formal 'Critique Schedule' to be distributed in advance as part of the pre-show information to the participating directors with another copy provided on site in the director's packet.  [Winter 2003 & Winter 2004]
   
Section 3. TICKET PRICE.  The ticket prices shall be consistent at all PIMBA-sanctioned regular season shows.  [Winter, 2001]
   
Section 4. EQUIPMENT & RESTRICTIONS.
   
Section A. Dropped equipment of any kind shall not be penalized.  Dropped items may be retrieved by the student, a staff member, designated adult, or judge without penalty.
Section B. Mechanized vehicles to pull equipment trailer for the set up and take down will be allowed unless prohibited by the individual site.
Section C. The following are not permitted:
  a.  Pyrotechnics of any kind, including fireworks, discharge of firearms, or any hazardous materials that may cause damage, present a safety hazard, remain on the field after the conclusion of the band's performance, or disrupt the scheduled flow of the event.
  b.  Lights-out routines
  c.  Animals
   
Section 5. ELECTRONICS.  All electronically produced music must be produced "live" and in "real time" by a student.  "Prerecorded" music, whether instrumental or vocal, may not be used.  PENALTY:  0.5 for use of prerecorded music.
   
Section 6. ELECTRICAL POWER. 
   
Section A. The use of electrical power shall be at the band's own risk, therefore PIMBA or Host Director shall not be liable for real or perceived failure or damage to a band's equipment from the use of electricity.  [Winter 2003]
Section B. The Host Director shall inform participating bands in the pre-show information materials whether or not electrical power will be available at field level.  [Winter, 1999]
   
Section 7. USE OF AMPLIFICATION IN WARM-UP AREA.  As a courtesy, bands shall not use metronomes amplified by a Long Ranger-type sound system in a marching warm-up area so as not to interfere with an adjacent band's marching or music warm-up.  [Fall, 1998]
   
Section 8. TABLES AT FIELD LEVEL.  All tables for displaying awards or for judges' use shall be clear from all field, pit, and trooping areas.  The director performing band shall have the right to have obstacles moved that he feels will interfere with his band's performance.
   
Section 9. TROOPING THE STANDS.  Trooping the stands shall be permitted as determined by the Host Director, who shall inform participating directors in the pre-show information materials if there will be trooping of the stands, precise instructions for the type and direction of trooping involved and whether trooping is required or optional.
   
Section 10. AWARDS CEREMONY. 
 
Section A. The Awards Ceremony shall be for the student leaders of each band as designated by its director.  [Fall 2001]
Section B. The placement and score of each performing band shall be announced over the public address system to the audience by class.

Article X - PIMBA-sanctioned Competitions:  The Judging
   
Section 1. CONTRACTED JUDGING ASSOCIATION. 
   
Section A. The accredited judging association for the next season shall be approved at the annual Winter Meeting.  [Summer 1997
Section B. Upon approval, PIMBA shall send the chosen judging association a formal letter of intent serving as the official contact and contract for the upcoming season.  [Fall 1997]
Section C. PIMBA shall abide by the 'tiered' classification system for judges and judging fees.  [Winter 2000]
Section D. The contracted judging association shall be the primary contractor of judges for PIMBA-sanctioned shows. [Fall 2001]
   
Section 2. PRIMARY JUDGE CONTRACTOR FOR 'DOUBLE SHOWS'.
   
Section A. PRIMARY JUDGE CONTRACTOR FOR 'DOUBLE SHOWS'. PIMBA shall be the primary contractor of outside judges for the two of its sanctioned shows that are scheduled on a given Saturday evening, known as 'double shows'. 
Section B. The Host Director of each involved double show has the first opportunity to contract the outside judges he prefers to adjudicate his show. Otherwise, the President shall do so.  [Winter 2003]
   
Section 3. AFFILIATION.  The PFCJ is to schedule the best available judges for PIMBA-sanctioned shows regardless of affiliation.  [Winter, 2001]
   
Section A. The contracted judging association shall schedule the best available judges for PIMBA-sanctioned shows regardless of affiliation.  [Winter, 2001]
Section B. Any judge who lives within 100 miles of Pittsburgh is considered a 'local' judge, thus should be contacted and contracted to judge PIMBA-sanctioned shows through the contracted 'local' judging association.  [Winter 2003]
   
Section 4. NORMAL SIZE OF ADJUDICATION PANEL.  Competitions shall be adjudicated by a full panel of members of the judging association.  A full panel is nine (9) adjudicators, including four music judges, three visual judges, one timing and penalties judge, and one tabulator. 
   
Section 5. EMERGENCY VACANCY ON A PANEL.  Should there be an emergency vacancy on a given judging panel, the field judges are to be transferred to the vacant caption and the ensemble judge's score shall be 'doubled' and used as the total.  [Fall 1998; Winter 2001]
   
Section 6. SCORE SHEETS & TAPES. 
   
Section A. As the score sheets used for PIMBA-sanctioned shows are PIMBA sheets, both the PIMBA logo and the logo of the contracted judging association shall appear as part of the heading on the front page of each with the appropriate criteria reference system boxes and descriptors on the back. Section B. The PFCJ tabulators will provide a full recap sheet, one showing the scoring of all captions and sub-captions. [Winter 1998; Winter 1999]
Section C. Judges' tapes shall be available at a designated area shortly following the band's performance.  Judging sheets shall be given to the Director or designated Staff member as soon as available at the conclusion of the show.  The only exception shall be at the Championship when the judging sheets will be given to the Drum Majors at the awards ceremony.
   
Section 7. ACCURACY OF YARD MARKERS.  The Timing & Penalties Judge of the sanctioned judging association is to ensure that the field yard markers are properly placed prior to each band's performance.
   
Section 8. PENALTIES. 
   
Section A. After total scores are tabulated, any penalties imposed will be deducted.  The resulting total score will be used to determine final placement of the competing bands.
Section B. If two or more bands have a tie in their final score, the higher placement will be awarded to the band with the higher raw score (subtotal before penalties).  If a tie remains, the higher placement will be awarded to the band with the highest total General Effect score.
Section C. Warnings will be issued in lieu of point penalties at all PIMBA-sanctioned shows through the first two weeks of the season.  [Fall, 1997]
Section D. The Timing and Penalties Judge shall be urged to identify possible penalties as early in the season as possible and be consistent throughout the season to avoid unwanted surprises at the Championship show. [Winter, 2004]
   
Section 9. POWER OUTAGE.  If the stadium lights go out during a performance, the judging shall cease and the performance of the band on the field at that time shall stop at the first available, logical, safe moment. The band affected shall have the opportunity to perform again at a time mutually agreed-upon among the affected band director, chief judge, Host Director, and PIMBA officers present. [Winter, 2004]
   
Section 10. AWARDS CEREMONY.  Trophy awards shall be given to all performing bands with the following awards presented in each class:  Placement Awards of 1st, 2nd, 3rd, 4th, etc.; and Caption Awards of High Music, High Visual, and High General Effect.
   
Section 11. CRITIQUE.  A critique will be held after the last judged band has performed at an appropriate location determined by the Host Director.
   
Section 12. TELEPHONE CONSULTATIONS.  For the purpose of better communication, a complete list of adjudicators from the contracted judging association with contact numbers shall be made available to the membership prior to the start of each season.  Each Director shall be permitted one five-minute phone conversation with a given judge within one week after participating in a PIMBA competition adjudicated by that judge.
   
Section 13. PROTOCOL FOR VOICING SIGNIFICANT CONCERN ABOUT A JUDGE DURING THE SEASON. 
   
Section A. JUDGES EVALUATION.  Directors are strongly encouraged to submit the annual evaluations in support of the "tier" judge classification system.  [Winter 2000]
Section B. A member Director with a significant concern regarding an individual judge during the season shall first contact the PIMBA President both to relay the nature of the concern and to determine any existing issue or pattern with that individual judge.  The President then shall choose whether or not to contact the Executive Director of the contracted judging association regarding the concern.  Copies of the involved sheets, recaps, and tapes should be provided.  The member Director retains the right to also contact the Executive Director of the contracted judging association if the President chooses not to pursue the concern further.  [Winter 2003]  
Section C. Significant concern with an individual judge after the season shall be expressed through the formal Judge Evaluation. Article XI - PIMBA Championship Competition
   
Section 1. CHAMPIONSHIP DATE.  The Championship Show shall be held on the first weekend in November to permit participation from 'dual membership' (Lakeshore) bands unless changed by the vote of the membership at the Winter Meeting.  [Winter 2003]
   
Section 2. CHAMPIONSHIP HOSTING. 
   
Section A. The Championship site for the next season shall be determined at the annual Winter Meeting.
Section B. A band wishing to host championships must be a voting member with a stadium with artificial turf.  [Winter 2003]  
Section C. The Championship site for the next season shall be determined at the annual Winter Meeting.  A school cannot host the Championships two consecutive years.  [Winter 1999]
   
Section 3. BAND PARTICIPATION. 
   
Section A. A Band is eligible to compete in the Championship show if it has participated in at least two sanctioned competitions during the season.
Section B. A band may still count as a performance a competition that it was scheduled to participate in that was canceled or moved indoors, or that it was forced to withdraw from due to inclement weather or format change. 
Section C. A member Band that has participated in one PIMBA-sanctioned competition may perform at the Championship Show in Judged Exhibition.  
Section D. Directors shall formally commit to participate in the Championship Show by the date two full weeks (fourteen calendar days) prior to the show date in order to give the Host Director ample preparation time.  A band that commits to participating after that time will perform first in class.  [Fall 1998]
Section E. A band that withdraws from the Championship show within two full weeks (fourteen days) of the show will lose a point in the show seeding system for hosting a PIMBA-sanctioned competition.  [Fall 1998]  
Section F. No exhibition performances, including by guest high school or university bands, shall be permitted given the number of participating member bands.  [Winter 2003]
   
Section 4. EVENT RESPONSIBILITY. 
   
Section A. PIMBA shall be an integral part of the overall planning for this event given its 'Championship status' and shall coordinate the appropriate facilities and procedural accommodations involved with the Championship Host Director.  [Winter 2003]  
Section B. The President or a designated representative shall be present on-site throught the event to address concerns in coordination with the Championship Host Director.  [Winter 2003]
   
Section 5. ORDER OF APPEARANCE.  The band appearance order for the Championship Show will be determined at a formal draw meeting. 
   
Section 6. SCHEDULE FORMAT.  The Championship Show shall be divided into two segments:  A/AA and AAA/AAAA/National, as first implemented in 2002 due to cold weather concerns.
 
Section 7. CHAMPIONSHIP HOST RESPONSIBILITIES.  The responsibilities of the Championship Host Director include, but are not limited to:
   
Section A. To  invite all eligible participating bands from the list provided by the Secretary to participate and confirm participation.
Section B. To  host the draw meeting for performance order at the host school no later than the Sunday preceding Championships and provide a walk-through of the facilities if requested.
Section C. To pay a Championship Rights Fee to PIMBA that includes the total judging fee.
Section D. To  supply trophies and awards.
Section E. To coordinate the medal presentation as part of the Awards Ceremony. Medals shall be presented to the student members of the Class Champion Bands. The medals shall be purchased by PIMBA as funded by an increase in the Championships Rights Fee. [Winter, 2004]
Section F. To provide a complimentary high-camera DVD or VHS for participating bands of the entire Championship Show for educational purposes only.  [Winter 2003]
Section G. If desired, to invite additional dignitaries from the school district, band parents, community or political representatives to participate in the awards ceremony in addition to the PIMBA officers and Executive Director of the contracted judging association.  [Winter 2003]
   
Section 8. TICKET PRICE. The ticket price for the Championship show shall be confirmed at the annual Winter Meeting. [Winter 2001]
   
Section 9. JUDGES.  PIMBA shall be the 'primary contractor' of all the judges for the Championship showy.  [Summer 1999, Executive Board Meeting]
   
Section 10. PENALTIES.  Each penalty at the Championship Show shall be reviewed and verified before scores are released by the tabulator to be announced at the awards ceremony.  [Winter, 2004]
   
Section 11. TROPHIES. 
   
Section A. The Championship host is responsible for the cost of providing the trophies.
Section B. The Host is to provide the placement trophies according to the following size guidelines:
      1st Place - 40-48"
      2nd Place - 36"
      3rd Place - 32"
      4th Place - 28"
      5th Place on - 24" 
Section C. The Host is to provide the caption trophies and may choose an appropriate style and size.
Section D. Use of the custom Jostens trophy for class champions is to be be discontinued due to excessive cost.  [Winter 2000]
Section E. PIMBA discontinued the practice of awarding traveling trophies. Existing traveling trophies remain property of the PIMBA and are on permanent loan to the 1997 Class Champions:  Serra Catholic (A), Beaver Area (AA), Gateway (AAA), and Norwin (Open/National).  [Winter 1998]   
   
Section 12. CHAMPIONSHIP SITE EVALUATION.  Member directors shall submit the Championship Site Evaluation by the annual Fall Meeting but not later than by the annual Winter Meeting. [Winter, 2004]
   
Section 13. FINANCIAL RESOLUTION FOR A CHAMPIONSHIP SHOW THAT CANNOT BE HELD IN ITS ENTIRETY.  [Winter 2000]
   
Section A. In the event that the PIMBA Championship Show cannot be held in its entirety due to inclement weather, field conditions, or other extenuating circumstances, the Championship Host remains responsible for the Championship Rights Fee.
Section B. In the event that the net profit of the Host Director's program divided by two is less than the Championship Rights Fee owed, PIMBA and the Host would split that net profit up to but not more than the fee.
Section C. In the event that the Host Director's program has suffered a net loss, PIMBA would evaluate the remaining financial responsibility on a case-by-case basis.  [Winter 2000]
   
Section 14. OUTSIDE VENDOR POLICIES.  [Winter 2003]
   
Section A. PIMBA shall negotiate with outside vendors wanting to sell souvenir items with the PIMBA logo involved (t-shirts, buttons, etc.) at the Championship Show (as well as during the season concerning design and related parameters with any profit designated for PIMBA).
Section B. PIMBA shall negotiate with preferred vendor for group band photos at Championships with parameters as coordinated with the Championship Host Director with any profit designated for PIMBA.
Section C. The Championship Host Director may choose to negotiate with outside vendors wanting 'booth' space concerning parameters involved with any profit designated for the Championship Host as the Host is providing the site arrangements.

Article XII - Student Eligibility & Adult Participation
   
Section 1. Each member of any participating band must be from the student body of the school district represented.
   
Section 2. All aspects of the field show must be performed by students.  No adult activity during the performance may contribute directly to the musical or visual program with three exceptions:
Section A. Adults may conduct the band at any time during the performance from outside the performance area.
Section B. Adults may set up and take down equipment before and after the performance.
Section C. Inclement weather may require intervention by parents when dealing with certain backdrops.  A decision with regard to permission to proceed with this intervention without penalty shall be made and communicated to the given director by the Timing and Penalties Judge prior to the band's performance.

Article XIII - Sanctions
   
Any flagrant violations of the Code of Ethics, Constitution, or Bylaws shall be brought before the Executive Board to investigate and recommend action to the membership.

Article XIV - Authority
   
Robert's Rules of Order (Revised Edition) shall be the Parliamentary authority on all questions not covered by the Constitution and Bylaws  and such standing rules as the membership may adopt.

Article XV - Dissolution
   
Upon dissolution of the PIMBA, after paying or making provision for the payment of all the liabilities of the organization, any assets shall be distributed to any organization which has established appropriate exempt status in Section 501(c)(3) of the Code, contribution to which are deductible, or to a state or local government exclusively for public purposes.

Article XVI - Effective Date of the Constitution & Bylaws
   
This Constitution and Bylaws shall become effective upon a two-thirds majority vote of the membership present at a duly called membership meeting.

Article XVII - Amendments
   
Amendment(s) to this Constitution and Bylaws of the Pennsylvania Interscholastic Marching Band Association may be proposed at any duly called membership meeting.  Amendments must be approved by a two-thirds majority vote.
